Fra den 28. januar 2016 skal alle ordregivere anvende Europa-Kommissionens standardformular for det fælleseuropæiske udbudsdokument - også kaldet ESPD’et. Efter denne dato kan den midlertidige danske ESPD ikke anvendes længere.
European Single Procurement Document eller i daglig tale ESPD er det nye altomfattende dokument på 23 sider, der skal bruges i forbindelse med alle udbudsforretninger under EU lovgivningen, dvs. også i forbindelse med alle danske udbud over tærskelværdien. ESPD'et erstatter bl.a. den tidligere tro og loveerklæring om gæld til det offentlige og andre udelukkelsesgrunde. ESPD'et er imidlertid samtidig det dokument, hvor man besvarer spørgsmål om virksomhedens kapaciteter, dvs. økonomiske, teknsik/faglige og andre kapaciteter.
ESPD'et er således primært tænkt til brug i forbindelse med prækvalifikation og udvælgelse af leverandører. Det er dog allerede nu set, at udbydere også bruger oplysningerne i ESPD'et i forbindelse med evaluering af tildeligskriterierne. Man må så håbe, at udbyderne i den forbindelse husker, at udvælgelseskriterier ikke må genbruges som tildelingskriterier.
Når man ser på indholdet, kan man let blive overvældet af, at skemaet indeholder langt mere tekst og forklaring end egentlig plads til besavrelse. Har man imidlertid øje for den strukturerede opdeling i Del I til Del VII, bliver tilgangen noget lettere. Del I udfyldes af udbyderen og Del II til Del VII udfyldes af tilbudsgiveren. Præcis hvad tilbudsgiveren skal udfylde skulle gerne fremgå af udbudsmaterialet. At blive fortrolig med udfyldelsen af de 23 sider kræver dog nok lidt tilvænning.
