Trods udbudsloven og flere kendelser fra KLFU - den seneste fra 22. februar 2018 - udbydes fortsat mange kontrakter, hvor der ikke er juridisk belæg for at kontraktperioden er længere end 4 år.
I henhold til udbudslovens § 95, stk. 2 er der kun i ekstraordinære tilfælde, at en kontrakt må løbe over mere end 4 år. Forhold, der kan tale for en længere periode, er, at kontrakten forudsætter, at ordrevinderen i væsentlig grad foretager udvikling, eller at der er særlige økonomiske forhold, der gør sig gældende. I de tilfælde skal kontrakten på forhånd udbydes i den ønskede længde.
Rigtig mange kontrakter udbydes som rammeaftaler, hvor produktet eller ydelsen er standardmæssig eller ganske sædvanlig, og i de tilfælde vil der ikke være mulighed for at kontrakten løber over mere end 4 år. Til trods herfor udbydes fortsat mange kontrakter af denne type, hvor der er indlagt en option ud over de 4 år.
I de tilfælde er der således grundlag for at klage til Klagenævnet for Udbud.
