Der kommer flere og flere "udbud efter forhandling", men hvad går "forhandling" ud på, og hvilke konsekvenser har det?
Udbud efter forhandling omfatter to ret forskellige forhandlingssituationer. Der kan ’forhandles’ om udbuddets indhold og om tilbuddenes indhold. I de fleste tilfælde forhandles der kun om enten udbuddets indhold eller om tilbuddenes indhold, men der er ikke noget i vejen for, at der forhandles om begge dele.
En hyppig årsag til at udbyder ønsker at vælge forhandlingsmodellen er, at udbyder har et lavt kendskab til det udbudte, og det kan lige så vel være et fysisk produkt som en serviceydelse, software eller andet.
I realiteten kommer tilbudsgiverne til at være med til at skrive udbudsmaterialet, hvilket giver virksomhederne en unik mulighed for at få indflydelse på udbuddet. Til gengæld kan arbejdsindsatsen gå hen og blive ganske betydelig.
Den anden gren af udbud efter forhandling koncentrerer sig om at forhandle med tilbudsgiverne og de tilbud, som de nu har afgivet. Der kan forhandles om både pris og de mere kvalitative vilkår, som tilbudsgiverne har tilbudt. Det kan at tilbudsgiverne opfattes som at tommelskruerne får endnu en omgang, og det er måske heller ikke helt forkert.
